The Affordable Care Act [Obamacare] upheld constitutional but the deciding vote was unexpected

NEWS FLASH: Today the supreme court ruled the ACA “obamacare” was constitutional because Pres. Obama and his attorneys argued that it was a “Tax” and therefore constitutional under the congressional power to levy taxes. When running for election Sen. Obama promised/lied that those who had an income of $250,000 or less would see no “new” taxes or tax increases; this Obamacare tax only takes into account the possession of insurance and doesn’t even consider income or personal status (one like myself might argue thats an improvement over previous reforms like welfare/food stamps). [no tax increase] Funny that when Obama gave his victory speech on the Supreme Courts ruling, during his 8 minutes of air time he never once mentioned the word “TAX” a word that was the single greatest factor for the courts decision and his win. [Victory speech]

What further adds to the surprise of today’s decision was that the deciding vote came from Justice John Roberts a moderate/conservative justice chosen by President George W. Bush. Prior to today many newscasters and political commentators believed that today’s decision would all ride on what Justice Anthony Kennedy had for breakfast believing it would be he not Roberts that would ride the fence. According to Justice Roberts, the federal government cannot compel citizens to engage in commerce(purchase insurance); furthermore the feral government cannot compel states to expand Medicaid by threatening the states Medicaid  funding (aka coercion).

Justice Roberts Opinion: That said how can Obamacares “individual mandate” still mandate citizens to buy insurance? Chef Justice Roberts stated: “Members of this Court are vested with the authority to interpret the law; we possess neither the expertise nor the prerogative to make policy judgments. Those decisions are entrusted to our Nation’s elected leaders, who can be thrown out of office if the people disagree with them. It is not our job to protect the people from the consequences of their political choices.”.[SCOTUS Ruling] The constitution has very few restrictions on the size, format, or quantity of the taxes congress can levy, however they did implement one major restriction “We the people…”. Meaning that our founders designed our constitution so that should a congress levy taxes in an obscene manner similar to the British then “we the people” could then vote them out and vote in people who would levy taxes in a much more sensible manner. Many believe that this was Justice Roberts intentions from the beginning, that by upholding the constitutionality of the mandate……err “TAX” then the people would ultimately vote out Pres. Obama and those who passed this act. Since only 39% of Americans support this legislation or “TAX”. [American polls]

BOTTOM LINE: Obamacare is back online and running at top speed after a brief derailment, not because the supreme court believed it was a good “TAX’ but because we put those politicians who implemented this “TAX” into power as outlined in our constitution. If you don’t want to have health insurance (or a health insurance that must meet Obamacare standards) and yet you don’t want to pay the ridiculous taxes either (i.e. lose money on your income rebates, be harassed by the IRS, etc), then come November vote out the politicians who implemented it and voted for it. Should you like the idea of getting an Obamacare approved health insurance or having to pay a tax (get a less tax rebate/deal with IRS) then vote to keep the politicians who implemented it.
